Well it seems Ty is at it again! He is now suing HolyBears and the owner, Rob LeClair.
Ty is alleging patent infringement on the Beanie Babie® design, and calling for all
HolyBears to be impounded & destroyed! If you put a HolyBear and a Beanie Babie
next to each other, you will see they are not alike. I personally am disapointed in Ty,
he seems to have become a bully. He uses his money, not for good, no instead to try
and intimidate others. He started with sueing websites that used the word "beanie" and
now he has gone on to sue just about any company making Bears! Yes Holybears is
not the first lawsuit, and the way Ty is going i am sure it wont be the last.


ANLETTER TO THE SUPPORTERS OF HOLYBEARS


Very little has changed over the centuries. There is always someone who believes they are strong enough to stop the spread of God's Word. The latest example, of curse, is Ty, Inc. - the company that has filed a lawsuit asking the courts to impound and destroy all HolyBears teddy bears because of alleged "copyright infringement." If you have one of our bears handy, pick it up and look at it carefully. Do you see the teddy bear face, the beaming smile, the embroidered religious design on the chest, and the message of God's Word attached to its paw? It's clear that our teddy bears have a purpose and a mission - and it will take more than a lawsuit to prevent them from spreading The Word!

I want to share three comments with you:

· First, our business is about spreading The Word - and we plan to continue doing exactly that at HolyBears. HolyBears independently developed our teddy bears, and we do not infringe on anyone's copyrights. We will continue to provide our teddy bears to our authorized dealers, and to churches and other religious groups who want to use our bears to raise funds.

· Second, HolyBears has enlisted a group of skilled attorneys who share our indignation that Ty, Inc. would file such a frivolous and baseless lawsuit. Defending our company will likely be an expensive undertaking, but we have the resources and the resolution to prevail in this battle.

· Third, we are asking every one of our friends to pray - not only for HolyBears and its mission of spreading The Word, but also for the founder, employees and attorneys of Ty, Inc. God has put us in this position for a reason, and we must trust in His wisdom as His purpose unfolds.

On a personal note, I want to thank everyone who has voiced support upon hearing about the lawsuit against HolyBears and against me personally. Some collectors and distributors have even called for establishing a "legal defense fund" to help ensure that HolyBears continue to spread The Word! Please know that we appreciate the show of support. Your words have been a great source of comfort and inspiration!

We are a relatively small company going up against a gargantuan toy manufacturer - but there is a Good Book that tells us about Davids defeating Goliaths. We've read The Book - and we are confident about the outcome.
