Terms and Conditions of Sale
All sales are subject to the following terms and conditions:
Returns
All sales are final. In unusual circumstances, returns will be at our discretion
and only if within 30 days of the invoice date. All returns must be authorized
by Cabd Collectibles. A 10% restocking fee will be charged on all orders returned
after they have been shipped. After an order has been shipped, we cannot refund
shipping charges or return postage. Within thirty (30) days of purchase, we
will replace or repair, at our sole discretion, any product that is deemed defective.
After 30 days, the manufacturer's warranty process (if applicable) must be followed.
Payment Method and Policy
When you have finished shopping, you will be taken to our checkout
page, where you will be asked to enter your payment details. We accept credit
card payments (Visa, MasterCard, American Express, Discover/Novus, Diners Club),
PayPal, Travelers checks, Business checks, Personal checks, Cashiers checks,
Money orders and registered concealed US cash. Please ensure that your credit
card number corresponds to your billing address.
** Please note that purchases made by credit card will be processed by our merchant
account at 2Checkout.com and will appear on your billing statement as "2CI*2CHECKOUT.COM
2CHECKOUT.COM". Purchases made using PayPal will appear on your billing
statement as "PAYPAL*CABDCOLLECTI".
If you choose to pay non-electonically via Check, Money order, Travelers check
or a Cashiers check please ensure that the payment method is cashable in the
USA and the payment method is drawn on a U.S. bank, otherwise the payment method
cannot be processed by us.

* For payments and purchases made using a non-electronic payment method, we
will hold your ordered item(s) for a maximum of 10 days until we receive your
payment. If payment is not received by 10 days after your order was submitted,
the item(s) you ordered will be automatically relisted back for sale on our
web site.
Shipping Fees
The shipping fee for the continental United States and US
military addresses is one flat rate: $5.95. We ship any size order
from one item to many items for this same fee. For Canadian
and United Kingdom orders the fee is $13.95. For shipments
to other countries not listed, please email us at Support
for pricing.
Note: For extra heavy orders, we may be unable to ship for our flat rate
and if so, we will notify you.
Shipping Damage
Report any damage or breakage of your merchandise upon receipt both to us and
to the carrier immediately. You MUST retain all packaging material
for the carrier's inspection. Before replacement merchandise can be shipped
to you, a damage claim must be filed.
Shipping Terms
Shipping terms are: F.O.B. Marysville, Ohio. Cabd Collectibles will arrange
payment for shipping with the carrier, but such costs are the responsibility
of customer. Risk of loss is upon customer once Cabd Collectibles delivers the
product to the carrier. Delivery times are estimates only and Cabd Collectibles
shall not be liable for delays.
Warranty Information
You are entitled to the manufacturer's limited expressed warranty, if any, that
accompanies the product. Cabd Collectibles makes no additional or independent
warranty. All other warranties, express or implied, including the warranties
of merchantability and fitness for a particular purpose are disclaimed. Cabd
Collectibles shall under no circumstances be liable for special, incidental,
or consequential damages including loss of profit, even if it has been advised
of the possibility of such damages; the maximum liability for all direct damages,
if any, arising out of any action shall be limited to an amount not to exceed
the purchase price of the product.
Errors and Omissions
Cabd Collectibles makes every effort to ensure the accuracy of the information
published in our catalogs and on our web site(s). However, the documents and
graphics published on this site may contain technical inaccuracies or typographical
errors. Cabd Collectibles makes no representations about the suitability of
the information and graphics presented on this site. All such documents and
graphics are provided "as is" without warranty of any kind.
If an error is made and a product is listed at an incorrect price, Cabd Collectibles
shall maintain the right to refuse or cancel any orders placed at the incorrect
price. If the order has been confirmed and charged to your credit card, Cabd
Collectibles shall immediately issue a credit in the amount of the incorrect
price.
Note: We do not guarantee Cabd Collectibles prices listed on other web
sites or price engines.
Special Note: Prices are subject to change without notice. We do not
list items we do not have in stock. However, occasionally the demand may exceed
the quantity available. If we are unable to fill your order within our usual
2-3 days, we will notify you.
Customer Acknowledgment
Customer acknowledges agreement with these Terms of Sale by the placement of
an order to purchase a Product from Cabd Collectibles.
All Sales Made In Ohio
Cabd Collectibles collects sales and use taxes for sales made to residents of
the State of Ohio.
All sales shall be deemed made in the State of Ohio, USA, regardless of the
location of the Customer. The Customer agrees that any dispute with Cabd Collectibles
arising out of the Customer's purchase from Cabd Collectibles shall be brought
by the Customer exclusively in the state or federal courts situated in the State
of Ohio; and the Customer hereby agrees that such venue is appropriate and that
Cabd Collectibles agreement to sell and deliver products to the Customer is
dependent on this provision.
Purchase Price
(a) Prices and promotions are listed in Cabd Collectibles catalogs and web site,
and are subject to change without notice. Prices for certain governmental, corporate,
and institutional customers may be set forth in a bid or other written agreement
between the parties.
(b) Payment is due before shipment, unless credit terms have been arranged in
advance with Cabd Collectibles Credit Department. In such case, payment terms
shall be as set forth in the credit agreement.
(c) Cabd Collectibles collects sales and use taxes for sales made to residents
of the State of Ohio. Cabd Collectibles shall not be liable for handling or
customs charges for shipments outside the United States.
LIMITED MANUFACTURER'S WARRANTY
(a) Cabd Collectibles warrants that it has good title to the Products it sells,
and that it has proper authority to license the software Products it distributes
(b) Cabd Collectibles. does not warrant the performance or integrity of any
Product, but merely passes through to the Customer whatever end-user warranty
the manufacturers or software publishers provide with their respective Products.
(c)STATEMENTS MADE TO YOU IN THE COURSE OF ANY PRIOR, CURRENT, OR FUTURE SALE
ARE SUBJECT TO THE YEAR 2000 INFORMATION AND READINESS DISCLOSURE ACT, (___U.S.
C.___) (P.L. 105-271). IN THE CASE OF A DISPUTE, THIS ACT MAY REDUCE YOUR LEGAL
RIGHTS REGARDING THE USE OF ANY SUCH STATEMENTS, UNLESS OTHERWISE SPECIFIED
BY YOUR CONTRACT OR TARIFF.
(d) Cabd Collectibles DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED BY
LAW, INCLUDING MERCHANTABILITY AND USE FOR A PARTICULAR PURPOSE.
LIMITATION OF LIABILITY
IN NO EVENT SHALL Cabd Collectibles BE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL
DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT OR OPPORTUNITY. CUSTOMER'S
SOLE AND EXCLUSIVE REMEDY IS STATED IN THE MANUFACTURER'S OR PUBLISHER'S END
USER WARRANTY ACCOMPANYING THE PRODUCT. IN NO EVENT SHALL Cabd Collectibles
LIABILITY EXCEED THE REPAIR, REPLACEMENT OR COST OF THE SPECIFIC PRODUCT PURCHASED
FROM Cabd Collectibles. SOME STATES MAY NOT RECOGNIZE A DISCLAIMER OR LIMITATION
OF WARRANTIES AND/OR LIMITATION OF LIABILITY SO THE ABOVE DISCLAIMERS MAY NOT
APPLY. CUSTOMER MAY ALSO HAVE DIFFERENT AND/OR ADDITIONAL RIGHTS AND REMEDIES
THAT VARY FROM STATE TO STATE.
Exclusive Agreement
These Terms of Sale represent the complete and final agreement between the Customer
and Cabd Collectibles for the matters set forth herein, and shall be supplemented
only by the prices, quantity, and descriptions set forth in Cabd Collectibles
invoice for the relevant sale. Terms contained in Customers' purchase orders,
offers to buy, terms and conditions, and the like shall have no effect.
General
(a) These Terms of Sale and any transactions made under them shall be interpreted
by and be subject to the laws of the State of Ohio.
(b) In the event any section or portion of a section of these Terms of Sale
are deemed unlawful or unenforceable, that section or portion of a section shall
be stricken from the Terms of Sale, and the remaining terms shall continue in
full force and effect.
(c) Cabd Collectibles shall not be responsible for damages or delays resulting
from Acts of God, and from other actions, both governmental and otherwise, including
but not limited to war, riot, seizure, and embargo.
(d)These Terms of Sale may be modified from time to time by Cabd Collectibles
without notice, and are current as of the date of the then current catalog or
Web site. Please refer to the current catalog or Web site.
